There is a procedure for e-document flow on labor protection

The Ministry of Economy approved the procedure for introducing electronic document management in the labor protection management system. The corresponding order of the ministry No. 839-21 of October 28, 2021 was registered with the Ministry of Justice of Ukraine on November 11, 2021 for No. 1488/37110. the order was published in the official gazette No. 90 of 26.11.2021.

The document defines a single procedure for implementing electronic document management in the labor protection management system.

Now the employer has the right to keep document flow on labor protection in electronic form.

And as soon as he makes such a decision (which should be issued with an order), he must simultaneously approve it:

- a list of documents that are supposed to be maintained in electronic form (hereinafter referred to as the list);

- procedure for creating, sending, transmitting, receiving, storing, processing, using and destroying documents specified in the list.

 

The employer is also obliged to provide:

- the period of storage of such electronic documents in the field of labor protection, not less than the period established for the relevant paper documents, including by using electronic signatures in a format suitable for long - term archival storage;

- the possibility of free familiarization of employees with documents, if such a possibility is provided for by regulatory acts;

- provision to state Labor officials, in cases stipulated by law, of copies of electronic documents that meet the requirements for electronic document management data formats established by law.

"The government and the Ministry of economy are constantly working to reduce the regulatory burden on businesses. Organizing work in the Occupational Health and safety management system is an important but rather complex process, especially for small businesses. The order of the Ministry of economy opens up new opportunities in the Occupational Health and safety management system and significantly simplifies the maintenance of relevant documentation. At the same time, it is important to note that the introduction of Electronic Document Management in the labor protection management system is not mandatory, it is exclusively an alternative option, at the choice of the employer. Each enterprise will be able to choose a convenient and comfortable format for itself," said Igor Dyadyura, Deputy Minister of economy of Ukraine for digital development, digital transformation and digitalization.

So, the approval of the procedure will contribute to:

- saving time and increasing the productivity of internal processes in business entities;

- optimization of internal and external communications;

- ensuring a continuous process of conducting online training and training at work in the context of a pandemic;

- improving the relationship between the customer and contractors in the Occupational Health and safety management system.
